What it says in Rule 3 (d) – Definition on page 46 of the One-Minute Guide to the Nautical Rules of the Road a US Power Squadron Guide about the term « Vessel engaged in fishing » means any vessel fishing with nets, lines , trawls, or other fishing apparatus which restrict maneuverablility, but does not include a vessel fishing with trolling lines or other apparatus which does not restrict maneuverability.
What it means... A sport-fishing, angling, or trolling boat is not a « Vessel engaged in fishing » for the purpose of the Rules. A lobster or crab boat might be when hauling or setting traps. The key issue is the degree to which the fishing apparatus limits maneuverability.
If you are sport fishing, don't take a chance because Rule 14 (a) - on page 67 of the One-Minute Guide to the Nautical Rules of the Road a US Power Squadron Guide says (Unless otherwise agreed) When two power-driven vessels are meeting on reciprocal or nearly reciprocal courses so as to involve risk of collision each shall alter her course to starboard so that each shall pass on the port side of the other.
